General Terms and Conditions

1. Overview
   Situated along the Auas Mountains, just south of Windhoek, IJG Trails offers a variety of outdoor activities suitable for the entire family, including mountain biking, hiking, trail running, dog walking, and bird watching, on over 100 kilometers of trails. To use the facilities, you must have a valid ‘membership’/ ’subscription’/ ’visitor pass’. A membership is obtained when registering via our website and purchasing a membership package through our online subscription method for which the Terms and Conditions are outlined herein. When using the facilities, you will have access to the trails (unless marked ‘no entry’) during the opening times, provided you abide by the Rules of Conduct and accept the Indemnity and Release.
2. Registering on our website
   You can sign-up to use the facilities by first registering via our website, creating a username and password to log in (hereafter “the Login Details”), and thereafter managing your profile. The profile page contains the personal details as well as photographs of the main member and any dependents. It also states the type of membership package, the subscription fees, the subscription term and the unique QR code. IJG Trails implements and maintains physical, technical and administrative security measures designed to protect your information. IJG Trails undertakes not to ‘sell’, ‘share’ or ‘process for targeted advertising purposes’ the personal data used to register. You shall not allow or authorize anyone other than the applicable and respective individual to use your Login Details. You shall promptly notify IJG Trails in the event that you become aware of any unauthorized use of the Login Details.
3. Billing
   3.1 Subscription and renewal: If you are subscribing to an IJG Trails membership package, you can sign up for either a monthly or annual subscription. Your subscription will automatically renew on a monthly or annual basis, as applicable. You can cancel your subscription at any time. If you cancel your subscription, you will not receive a refund or credit for any amounts that have already been billed.
   3.2 Billing date: The applicable “Billing Date” is as follows: (i) if you are on a monthly subscription, the date of your subscription and monthly thereafter; (ii) if you are on an annual subscription, the start date of your subscription and annually thereafter, in each case on the respective anniversary of the subscription date.
   3.3 Taxes: Your subscription fees are inclusive of 15% VAT as stipulated by the applicable laws and regulations of the Republic of Namibia. Tax rates are calculated based on the applicable tax rate at the time of your subscription application, renewal, or charge, as the case may be.
   3.4 Cancellation and changes: You can stop using the facility and/or cancel or change your subscription at any time via your profile settings. If you cancel or change your subscription you will not be entitled to a refund of any fees already paid, and any outstanding fees will become immediately due and payable.
   3.5 Changes to Pricing: IJG Trails reserves the right to change its prices at any time. If you are on a subscription plan, pricing changes will not apply until your next renewal.
   3.6 Billing Communication: by concluding a subscription with IJG Trails, you agree that IJG Trails may contact you at any time by email, SMS, or any other method with information relevant to your subscription, billing, and use of the Service.
4. Access to the facility
   A unique QR code is generated as the means of access control at the official entry points to the facility. You download the QR code (from your profile page) to display to the security guard who will scan it and confirm the identity and validity of the membership. Access will only be granted upon positive identification from the photograph loaded onto your profile and a valid and active subscription.
5. Provision of service
   After successfully paying the Subscription fee (the recurring fee paid to access the facilities) and subject to the Terms and Conditions herein, IJG Trails will provide you with access to and use of the facility, for the duration of the subscription term, upon presentation of the QR code to the security guard, but at all times subject to all relevant Terms and Conditions. IJG Trails may, at its sole discretion, modify, remove, add, or enhance features of the facility from time to time, provided, however, IJG Trails will not materially decrease the overall functionality of the facility during the subscription term.
6. Use Restrictions
   You shall not yourself or through any family, friend, employee, contractor, agent, or other third party i) rent, lease, sell, distribute, offer in service bureau, sublicense, or otherwise make available the facility to any third party other than yourself; ii) copy, replicate, modify, or create derivative works of the facility, or any part thereof; iii) access the facility for purposes of building or marketing a competitive product. Access to the facility is granted, provided you abide by the ‘Rules of Conduct’ and accept the ‘Indemnity and Release’, and IJG Trails reserves right to admission at all times.
