This document serves to confirm that the you, regardless of whether or not you are a subscriber for any or all of the services and/or offerings made available by ‘IJG Trails’ at their premises (the ‘Premises), hereby agrees to full release, indemnify, and hold harmless ‘IJG Trails’ from all inherent and real dangers and risks that are associated with your usage and presence of and on the Premises and/or IJG Trails’ facilities, including but not limited to any damage or harm of whatsoever nature arising from the presence of wild and dangerous animals, reptiles, birds and insects and the real risk of bodily harm, sickness, personal injury, death and/or damage to property which may arise from your utilisation of the facilities, whether at the Premises or otherwise.

You expressly agree that you have familiarised yourself with the relevant details of any and all inherent and real dangers and risks that are associated with the utilisation of the facilities and/or the Premises arising from the presence of wild and dangerous animals, reptiles, birds and insects and the real risk of bodily harm, sickness, personal injury, death and/or damage to property which may arise. Your utilisation of the facilities and/or the Premises is done willingly and no one is forcing and/or coercing you, or otherwise, to make use of such facilities and/or the Premises, and you elect to utilise same in spite of the risks, and at all times with full knowledge of the inherent risks, hazards and dangers involved, whether foreseen or unforeseen.

Furthermore, you acknowledge that it is a condition of admission to the Premises that if you have children accept full responsibility for the actions and safety of your children under your control. The nature of the utilisation of the facilities and the Premises is such that it is potentially dangerous for children, and guardians are expected to control their children, including those children in their care, to prevent them from harming themselves and/or inconveniencing other clients.

I hereby, on my own behalf and on behalf of my heirs, successors, agents, executors, and/or subrogates, hereby knowingly and intentionally waive and release, indemnify, and hold harmless IJG Trails, their directors, officers, agents, employees, and volunteers from and against any and all claims, actions, causes of actions, liabilities, suits, expenses, including legal fees and any claims for damages of whatsoever nature, which are related to, arise out of, or are in any way connected with my utilisation of the facilities and/or the Premises, including, but not limited to, negligence of any kind or nature, whether foreseen or unforeseen, arising indirectly out of any damage, loss, injury, paralysis, or death to me or my property as a result of my utilisation of the facilities and/or Premises, whether such damage, loss, injury, paralysis, or death results from negligence of IJG Trails or from some other cause.
